In the case opened regarding the claim that the image of a person who was detained in Bağcılar, Istanbul and made to wear a wig was shared on social media, the public prosecutor announced his opinion and demanded that the 5 defendants, including the leader of the Young Fenerbahçe fans, Cem Gölbaşı, be sentenced to 18 years and 6 months in prison each for various crimes.

The hearing at the Bakırköy 22nd High Criminal Court was attended by the defendants Cem Gölbaşı, İsmail Atan, Süleyman Şahin, Şahin Beyazyıldız and Hasan Mert Şahin, who are not under arrest. The defendants' lawyers were also present at the hearing.

At the hearing, the public prosecutor announced his opinion on the merits.

In the opinion, it was stated that the defendants Cem Gölbaşı, Umut Özaydın, Şahin Beyazyıldız, İsmail Atan and Süleyman Şahin went to the workplace of the complainant Burhan İvecen, the complainant and Gölbaşı talked, and during this time Gölbaşı took the complainant's mobile phone without his consent when he did not want to give it to him, and kicked the complainant.

In the opinion, it was recorded that the defendants took the complainant with them to the warehouse where the incident continued, and it was stated that it was determined that the footage of the complainant İvecen, who is the subject of the investigation, was shot here by the defendant Gölbaşı.

In the opinion, it was mentioned that there were messages containing threats and insults towards İvencen on the phones belonging to the defendants Yunus Akbalık, Şahin Beyazyıldız and Hasan Mert Şahin.

It was reported in the opinion that the defendants shared the images they had taken by entering the application on İvecen's phone without his consent.

UP TO 18 YEARS AND 6 MONTHS PRISON REQUESTED

In his opinion, the prosecutor requested that the defendants Cem Gölbaşı, Umut Özaydın, Şahin Beyazyıldız, İsmail Atan and Süleyman Şahin be sentenced to prison terms of 9 to 18 years and 6 months each for the crimes of "illegally providing or obtaining personal data", "robbery of a residence, workplace or annexes by blocking a road by more than one person together" and "deprivation of liberty by using force, threat or deception by more than one person together".

In the opinion, it was requested that these defendants be acquitted separately from the crime of "torture".

In the opinion stating that the defendants Yunus Akbalık and Hasan Mert Şahin had agreed on the charges of "threat" and "insult", it was requested that the case be dropped for these defendants.

In his defense, the defendant Cem Gölbaşı said that the complainant gave the phone to him of his own free will, that he was not taken by force, and that he did not accept the accusation.

He said that the other defendants repeated their previous defenses and requested their acquittal.

The court adjourned the hearing so that the defendants' lawyers could present their defence on the merits.

FROM THE INDICTMENT

In the indictment prepared by the Bakırköy Public Prosecutor's Office, it is stated that the complainant Burhan İvecen is the owner and sole administrator of an account with the nickname "@Buyukeksi" on a social media application, that he shares football content, that he has approximately 23 thousand followers, and that he shares humorous posts in line with the news on social media about the Fenerbahçe tribune leader defendant Cem Gölbaşı.

In the indictment, it is stated that on the date of the incident, while the complainant was at his brother-in-law's workplace, the defendant Cem Gölbaşı came to the workplace with a few people, took his phone without his consent and entered his social media account, asked who made the posts on the application, and the complainant said that he had shared the images on the internet by editing them, and apologized.

The indictment, which describes how the defendants took the complainant out of her workplace against her will and took her to a warehouse-like place, forcing her to wear a wig and recording her image, demands a prison sentence of 2 to 5 years for the defendants Cem Gölbaşı, İsmail Atan, Süleyman Şahin, Şahin Beyazyıldız and Umut Özaydın for "violating the privacy of private life", 4 to 14 years for "deprivation of liberty by more than one person", 2 to 5 years for "torture", 1 year for "entering an information system", 10 to 15 years for "aggravated looting by blocking a road or in a residence, workplace or their annexes with more than one person", and 2 to 4 years for "unlawfully providing or obtaining data".

The indictment demands a prison sentence of 3 months to 2 years for defendants Hasan Mert Şahin and Yunus Akbalık for the crime of "insult" and 2 to 5 years for the crime of "threatening more than one person."
