ARTICLE 2-) THE WORK SUBJECT TO THE TENDER

ARTICLE 4-) THOSE WHO CAN PARTICIPATE IN THE TENDER:
Participation in this tender is open to individuals and legal entities who meet the qualifications specified in the Tender Law. Participation in the tender requires meeting the qualifications specified in State Tender Law No. 2886 and the regulation issued pursuant to Article 74 of this law, submitting an offer as described in the aforementioned law and regulation, depositing the provisional and tender participation guarantee, and possessing the required documents.
ARTICLE 5-) THOSE WHO CANNOT PARTICIPATE IN THE TENDER:
Those listed in Article 6 of Law No. 2886 and those listed in Article 83 are not permitted to participate in tenders, either directly or through a mediator. If those who disregard this prohibition and enter the tender are found to have entered the auction and been awarded a contract, the tender will be annulled, and the provisional and participation guarantees will be forfeited. If a contract has already been made, the contract will be terminated, and the final guarantee will be recorded as revenue.
ARTICLE 6-) TENDER COMMISSION
The tender committee is free to decide whether or not to conduct the tender, stating the reason in the decision. A decision not to conduct the tender cannot be appealed.
ARTICLE 7-) DOCUMENTS TO BE REQUIRED FROM TENDER PARTICIPANTS:
Provided that it is the original or a notarized copy of the document received within the year in which the tender was made;
A) FROM NATURAL PERSONS
1-Proof of residence. 2-Criminal record certificate. 3-Certificate of no tax debt. 4-Copy of identity card. 5-Certificate of identity registration. 6-In case of representation, a notarized power of attorney and signature declaration of the principal. 7-In case of a joint venture, a notarized Joint Venture Declaration. 8-Temporary guarantee letter or receipt.
9 - A receipt showing that the provisional guarantee amount, determined by the commission at a rate of 3% of the estimated price, was deposited to the Çiçekdağı Municipality Collection Service or to the Ziraat Bankası Çiçekdağı Branch TR55 0001 00 03 8033 6367 6750 03, or the values accepted as provisional guarantees specified in Article 26 of the State Tender Law No. 2886. (The receipt should include the name and surname of the person or company participating in the tender, the name of the company whose tender was held, and the "provisional guarantee amount".)
B) FROM LEGAL PERSONS
1- Document proving that the legal entity is registered in the registry, obtained from the administration where the legal entity is registered (from the Directorate of Associations, the Chamber of Commerce or Industry, the Trade Registry Directorate, the court where the administrative center is located, or the relevant authority) within the year in which the tender was held. 2- Notarized signature circular (for associations, a certified copy of the relevant page of the decision book and a notarized signature declaration of the authorized person). 3- Temporary guarantee letter or receipt. 4- Document proving that there are no tax debts. 5- In case of representation, a notarized power of attorney and a signature declaration of the principal.
6- In case of a joint venture, a Joint Venture Declaration approved by a Notary Public.
ARTICLE 8-) THE FOLLOWING ARE TAKEN AS PROVISIONAL AND DEFINITIVE GUARANTEE:
a) Turkish Currency in circulation. b) Indefinite letters of guarantee to be given by banks and private financial institutions. c) State domestic debt securities issued by the Undersecretariat of Treasury or documents issued in place of these securities (If the nominal value is included in the interest, the sales values corresponding to the principal are taken as basis in these transactions).
ARTICLE 9-) APPLICATIONS
For applications submitted by mail, the offer must be prepared in accordance with Article 37 of the State Procurement Law No. 2886 and must reach the Commission by the tender deadline. Offers that do not reach the Commission by the tender deadline due to postal delays will not be processed.
