They are asking the Justice system to stop Gildo Insfrán's maneuver to be re-elected in Formosa, and if not, for Milei to "intervene in the province".

On Saturday, Senator Francisco Paoltroni, a member of the ruling party, asked the Attorney General and the Supreme Court to rule on the maneuver by Formosa's Kirchnerist governor, Gildo Insfrán, which would allow him to govern for four more years, despite the fact that the nation's highest court declared the clause in the provincial constitution that allows indefinite re-election unconstitutional.
Paoltroni, now with his own bloc but who went to the October 26 elections in alliance with the ruling party, said that if the Justice system does not rule, President Javier Milei must ask Congress for its approval to intervene in the province governed by Insfrán for 20 years , he said in statements to Dato sobre Dato on Radio Milenium.
In September, the Formosa Constitutional Convention—with Insfrán holding a majority—amended the provincial constitution to eliminate indefinite reelection. However, a transitional clause passed in the same session allows Governor Gildo Insfrán to run again, redefining the conditions of his continued hold on power after nearly three decades.
The possibility of a new candidacy for the current governor rests on a specific legal mechanism. Although the reform to Article 132 of the provincial Constitution prohibits perpetual terms, the Constitutional Convention, controlled by the ruling party, approved a key provision: Transitional Clause 4.
This section states that “the term of office of the governor and vice-governor in office at the time this reform is enacted shall be considered as the first term.” Paoltroni explained that Insfrán understands the prohibition to apply from the start of a new term. In practice, this means that Insfrán’s current term (2023-2027) counts as the first under the new regulations.
In this way, the governor is eligible to compete for a second and final consecutive term in the 2027 elections.
“As President Milei rightly says, it is impossible to have a dialogue with those who defend and even cite Insfrán as an example, a character who has kept Formosa subjugated for 30 years, a province where there is no justice, private property or work,” he added.
The senator stated that “Formosa is being held hostage. The people of Formosa are hostages of an illegitimate governor who cheated to perpetuate himself in power and who, in every election, uses the most despicable tactics to maintain his model of poverty.”
He said that his alliance secured a national deputy seat last Sunday because "people accompanied the deputy who was running with LLA and managed to get a deputy elected."
He then clarified that "it is still being discussed whether I will be part of the LLA bloc" which will be chaired by Patricia Bullrich starting on December 10.
“In Congress we will have an absolute majority, due to the alignment of the governors who are in dialogue with the President,” Paoltroni assured.
Commenting on his Kirchnerist colleague, José Mayans, he said, “An accomplice of Insfrán, who defends an authoritarian government and has been sitting in the National Senate for over two decades thanks to an illegitimate governor who has concentrated all power in Formosa for 30 years, cannot speak of arrogance. Unacceptable.”
