Fire at Ninho: Rio de Janeiro Public Prosecutor's Office sees legal error and tries to overturn acquittal of defendants.

The Public Prosecutor's Office of Rio de Janeiro presented its appeals on Monday (10) regarding the acquittal of the defendants in the case of the fire at Ninho do Urubu. The tragedy, which occurred in February 2019, killed ten players from Flamengo 's youth academy. Thus, four prosecutors argued that the decision "was based on a mistaken perception of doubt", according to "ESPN".
The document was signed by prosecutors Márcio Almeida Ribeiro da Silva, Décio Luiz Alonso Gomes, Yan Portes Vieira de Souza, and Ana Cristina Fernandes Villela. In this way, they argued that the acquittal also "finds no support in the technical evidence nor in the logic of the facts."
In total, 11 people were charged with the crime of aggravated negligent arson. Before the acquittal of the last seven defendants, four others had already been granted this right. Among them was the former president of Flamengo, Eduardo Bandeira de Mello. However, the appeal from the Rio de Janeiro Public Prosecutor's Office seeks a reconsideration of the situations of Flamengo and the former president.
In the case of Eduardo Bandeira de Mello, the law stipulates that, for defendants over 70 years of age, criminal liability is extinguished. Currently, Bandeira is 72. However, the Rio de Janeiro Public Prosecutor's Office has stated that, should the acquittal be upheld in the second instance of the Rio de Janeiro courts, it will appeal. In other words, it will take the matter to "higher appeals courts - the Supreme Federal Court and the Superior Court of Justice".
