In an interview with Rossiyskaya Gazeta , lawyer and head of the Law and Order Center for Moscow and the Moscow Region, Alexander Khaminsky, warned of the risk of administrative and criminal liability when using artificial intelligence (AI) to process personal data.

The publication's source noted that legal entities and individual entrepreneurs who use citizens' personal information in their activities are considered personal data operators, and under Russian law, they have a number of obligations, failure to comply with which can result in fines and, in some cases, criminal liability.

The expert noted that many companies today are increasingly using AI in their operations, which helps them work with large volumes of data, process it, and quickly obtain the desired results. However, it is important to remember that using AI to process personal data can lead to administrative and criminal liability.

Khaminsky emphasized that AI platforms are typically owned by third-party organizations, but the transfer of personal data to third parties in most cases requires the written consent of the data subject. As the lawyer noted, if one examines the personal data processing policies of the world's leading AI platforms, it becomes clear that such companies not only happily collect personal data but also actively use it in their operations.

Therefore, according to the publication's source, the transfer of personal data, whether intentional or accidental, for AI processing would clearly constitute a violation of the law.
