Lawyer Mandzhieva: Summer residents may lose their plots due to improper use

Leading lawyer at the European Court of Justice, Srbuhi Mandzhieva, told the Prime agency about the types of construction Russians are prohibited from building on their dachas. Violating the rules could even result in the loss of their land.
According to Mandzhieva, it is prohibited to build hotels, apartment buildings, auto repair shops, restaurants, and other premises that will be used for commercial purposes on summer cottage plots.
"To do this, the land must first be zoned for commercial use: hotel services, catering, and the like," the lawyer explained.
Failure to heed these requirements can result in administrative or even criminal penalties, including land confiscation. The fine depends on the cadastral value and is determined as a percentage of it.
Garden houses or residential buildings can be built on summer cottages. The main difference is that a garden house does not allow registration and does not require utilities. The house must be detached, no higher than three stories (basements not included), and no more than 20 meters high.
In addition, it is possible to build a bathhouse, garage and other outbuildings, if this does not conflict with fire safety.
However, the lawyer advises ordering an extract from the Urban Development Plan of the land plot (UDP) before construction and reviewing the permitted uses of the plot before proceeding with construction.
