Moraes grants house arrest to 74-year-old man convicted of January 8

Supreme Court Justice Alexandre de Moraes granted house arrest to Miguel Cândido da Silva, 74, sentenced to 11 years and 11 months in prison for involvement in the coup acts of January 8 , 2023.

According to the judge, the man's health condition authorizes the measure — the records indicate that he suffers from bilateral inguinal hernia, with progressive worsening of the pain.

The STF's jurisprudence, Moraes added, allows the granting of domicile even when the objective requirements for progression are absent.

The defendant has been in prison since June 6 of last year. In the new decision, signed last Friday the 25th, the minister states that Miguel will have to request authorization from the STF for travel related to his health, with the exception of emergency situations — these will have to be justified up to 48 hours after the medical procedure.

“Failure to comply with house arrest or any of the alternative measures will result in the conversion of house arrest into imprisonment within a prison establishment,” wrote Moraes.
