Collor appeals and asks Moraes to extinguish the sentence for passive corruption

Former President Fernando Collor filed a request this Friday 9th to Minister Alexandre de Moraes , of the Federal Supreme Court, for his sentence for passive corruption to be prescribed.
The defense argues that there was a period of more than six years between the crime and the formal accusation. This time, according to the lawyers, would demonstrate the statute of limitations on the punitive claim – that is, the state would have lost the right to punish Collor for the crime.
“The appellant requests the knowledge and provision of this procedural appeal, with immediate reconsideration by the rapporteur or, if he does not understand it that way, that the Plenary recognizes the flagrant prescription of the punitive claim regarding the crime of passive corruption”, says the text.
Even if Moraes accepts the defense's request, Collor would not be free from the risk of returning to prison, since he was also convicted of money laundering.
The politician from Alagoas was sentenced to 8 years and 10 months in prison for having received 20 million reais to illegally facilitate contracts between the state-owned company and UTC Engenharia aimed at the construction of fuel distribution bases.
He was arrested on April 25, in Maceió, but his arrest was converted to house arrest by Minister Alexandre de Moraes on April 1.
When ordering the release of the former president, Moraes took into account the defense's appeals regarding the fact that Collor is undergoing treatment for Parkinson's Disease, and that imprisonment would be detrimental to necessary health procedures.
