She died after being hit by a repeat offender. The tragedy doesn't end there. Parents in courtroom hell.

On September 26, 2018, a tragedy occurred in Lublin that irrevocably changed the lives of the Tchorzewski family. At a pedestrian crossing, 12-year-old Wiktoria was fatally struck by a car driven by Józef B., a professional driver. The same man had also fatally struck a person at a pedestrian crossing more than a decade earlier.
The girl was on her way to school, but her journey ended in the hospital, where, after several days of fighting for her life, doctors declared her brain dead. The criminal trial in this case concluded with a clear verdict.
"He exceeded the speed limit by 22 km/h . Secondly, he failed to properly observe the roadway and the intersection area, as well as the pedestrian crossing behind it. He failed to exercise due caution in that area. Thirdly, he attempted to avoid another vehicle that had stopped in the right-hand lane of the same roadway in order to yield to the girl," says Andrzej Mikołajewski of the District Court in Lublin.

Courts of three instances, including the Supreme Court, confirmed Józef B.'s guilt and ruled out any involvement of the victim in the accident . The driver was sentenced to three years' imprisonment without parole—a sentence that is extremely rare in cases of this type.
They're trying to blame the victim for the accident. The expert suddenly changed his mind.However, the family's nightmare didn't end there. Following the criminal trial, civil proceedings began, in which the perpetrator's insurer is attempting to establish the victim's guilt . Contrary to the findings of the criminal courts, the court documents began to argue that Wiktoria entered the crosswalk in a manner that inherently created a hazard. Furthermore, an expert opinion emerged in the case, which has generated considerable controversy. Initially, he clearly identified the driver as responsible for the hazard, but later, in a supplementary opinion, he reversed his position, claiming the pedestrian's behavior was the cause . He cited a "typographical error" as an explanation, although in reality, this completely reversed the previous findings.
The family is outraged. For the girl's loved ones, each hearing and each document brings back the most tragic moments of their lives.

"Hearing this emphasis on contributing, I said I wouldn't let it go. I couldn't agree to this. It's not about money, it's about not agreeing to anyone blaming Wiktoria, to a greater or lesser extent, for this accident," says Katarzyna Tchorzewska.
Instead of grieving peacefully, the girl's loved ones must constantly contend with attempts to question the perpetrator's guilt , whose liability has already been legally established. Ludwik Nawrocki, the family's attorney, emphasizes that this is a standard tactic employed by the insurer.
