Serrara, the “forgotten” competition has been cancelled. The Council has decided to cancel it in self-regulation

The Municipality of Serrara Fontana did not conclude the competition announced over a year ago for the hiring of a financial instructor and had to take the consequent decisions. The Council in fact gave the direction to the head of the III Sector to proceed with the cancellation in self-protection of the announcement, but at the same time proceed to start a new competition procedure.

A somewhat singular case, summarized in the resolution. With the resolution adopted on May 10, 2024, the Area manager had approved the public competition announcement for qualifications and exams to fill a part-time and permanent position in the professional profile of administrative accounting services, instructor area (formerly cat. C), to be assigned to the III Economic-Financial Sector. The announcement had been published on the institutional website of the Municipality and on the “InPa” portal on the same date, that is, May 10.

The fact is that, as the Board now highlights, the announcement "set a deadline for the conclusion of the procedure of 6 months starting from the date of publication of the selection notice". And the relevant law also establishes the same maximum deadline of six months for the conclusion of a competition, from the publication of the announcement to the publication of a ranking. The resolution acknowledges "the failure to comply with the procedural deadlines established by the competition announcement and by the legislation in force on the matter", but does not indicate the causes.

Instead, it is relevant to the existence of the legal conditions that allow for the cancellation to be carried out in self-regulation pursuant to Law 241/1990. The same notice, moreover, provided for the faculty for the Municipality "to extend, to reopen the deadlines, to rectify, as well as to revoke the notice, with a duly motivated provision for reasons of protection of the public interest".

The competitive procedure to be annulled, attests the Board chaired by Irene Iacono, "has not been completed nor has it been perfected with the adoption of the ranking and the nomination of the winner, since only the publication of the relative announcement has been put in place, and that, therefore, qualified and protected subjective positions are not affected". A "forgotten" competition. The fact is that the three-year personnel requirement plan for the period 2025/2027 approved in January provides for the hiring of a part-time and permanent unit in the Instructors Area to be assigned to the III Economic and Financial Sector.

Given the need to fill the vacant position in the organization and to "cancel" that competition procedure that has now become illegitimate, the head of the III Sector, Ms. Lucia Cenatiempo, was given the direction to proceed with the cancellation in self-regulation and to announce the new competition announcement, with the "warning" to "conclude the competition procedure within 6 months from the announcement". Given the urgency, the resolution of the Board was declared immediately enforceable.
