Barça's case against Ter Stegen "has no future and is a potential pressure measure."

Barça's case against Ter Stegen "has no future and is a potential pressure measure."

Marc-André ter Stegen's decision not to authorize the sending of his medical reports to LaLiga has caused a stir at Barça . The German goalkeeper stated that he would be "out for about three months," while the club hoped to reach an agreement on Ter Stegen's medical reports that would extend his absence beyond four months.

That situation would have facilitated the registration of Joan García and Wojciech Szczęsny in LaLiga, given that they could have used the 50% of their salary margin freed up by the German. However, ter Stegen , with a contract until 2028, responded with a refusal and blew up Barça's strategy, forcing the club to seek other registration channels, such as the validation of the sale of the Camp Nou VIP boxes by its auditor, player sales, or new sponsors such as the Democratic Republic of the Congo.

From that moment on, the club, as reported by Mundo Deportivo, decided to bring the case to its lawyers so that "they can immediately open a disciplinary case against him, which could result in an internal sanction within the club itself if the board approves it." However, according to what El Confidencial has learned from official sources at the AFE (Spanish Footballers' Association) , Barça could not open a disciplinary case against him that would result in a sanction for refusing to provide his medical information.

"A pressure measure? Possibly."

What's more, even if the request were to be made , "it would have no scope or impact," according to the Spanish players' union. Internal sources within the union affirm that Barça's measure will not prosper and is based on two primary arguments. The first is that, according to the workers' statute, no one is required to provide medical information unless that person is temporarily incapacitated for a health-related issue, in which case they must notify the company.

Secondly, there is the collective bargaining agreement that covers the regulations for the First and Second Divisions , which also does not contemplate opening a case for refusing to provide his medical information . AFE, as it did with Dani Olmo and Pau Víctor last season, is in constant contact with the German player and will provide support and legal advice if Ter Stegen so requests.

"Is this a pressure measure? Well, possibly," explains AFE. The union assures that "if the club follows this path, there will be other avenues to explore ," although they also maintain that it is the player who must make the final decision.

Signing without having salary margin

For its part, Mundo Deportivo , the newspaper that exclusively published ter Stegen's refusal to share his medical data, reports that the current collective agreement between LaLiga and AFE considers "disobedience that involves a serious breach of discipline or causes serious harm to the club , including a breach of sanction" to be very serious.

Barça signed three players (Joan García, Szczesny, and Marcus Rashford ) without having the salary margin to register them. Ter Stegen has seen how Barça wanted to replace him with Joan García and Szczesny after 11 seasons at the club, and now they have rudely shown him the exit door . War is brewing in the Barça offices.
